1.         This meeting of the Planning Commission of the City of Cedar Hills, having been posted throughout the City and the press notified, was called to order at 7:05 p.m. by Alan Petersen.

 

2.         Approval of the Minutes from the September 29, 2005, Regular Planning Commission Meeting (7:05 p.m.)


MOTION: C. Volden - To approve the minutes from the September 29, 2005, Regular Planning Commission Meeting, subject to the noted changes. Seconded by C. Richardson.

3.         Review/Recommendation to Grant a Variance for Canyon Heights, Plat G, Lot 6 (7:07 p.m.)

 

See handouts. Rodney Despain reported that this item was discussed during the last meeting. Currently, Canyon Heights, Plat G, Lot 6, has a 54-foot front setback. This setback makes it difficult for the owner to tie into the sewer and would also force them further down the hill. There are certain default setbacks in the development, but the developer can create setbacks that are varied from the default. The 54-foot setback appears to be a continuation of the setback on Lot 5. The City does not know why the developer made the 54-foot setback. Previously, Rodney Despain recommended that an amendment be made to the plat. The applicant requested another way to change the setback. Rodney Despain has prepared a Release of Building Setback document. This would change the setback, but would not amend the plat. Staff does not feel there is any undue problem caused by the execution of the Release of Building Setback. C. Hammer suggested that legal counsel review the document. C. Petersen pointed out that no one would be adversely affected by the change.


MOTION: C. Richardson - Regarding the request to recommend the approval of a designated setback envelope at variance with the recorded setback distances for Canyon Heights, Plat G, Lot 6, I move we make the following findings of fact: (1) The revised lotting plan for Canyon Heights, Plat G, Lot 6, does not create a hazardous condition. Emergency vehicle access has not been negatively compromised, (2) Varying from the designated setback envelope is appropriate for the zone and property location, (3) The recording of the existing building envelope was approved by the City, but approval was based on an incorrect designation of the front lot line and proper setback distance, (4) The revised lot plan does not change the development’s density nor open space between dwellings. It also complies with the zoning regulations for the zone in which it lies. Furthermore, pursuant to Paragraph 2 of Section 10-6B-7 E of the Cedar Hills Zoning Ordinance, I recommend approval of a designated setback envelope at variance with the recorded setback distance as proposed, subject to the following conditions: 1) Engineering, 2) Fire Chief approval, 3) Legal review, and 4) The Release of Building Setback being recorded at the County showing a 30-foot front setback. Seconded by C. Hammer.

4.         Committee Assignments and Reports (7:19 p.m.)

 

          C. Hammer - The Parks and Trails Committee cancelled their meeting but had the unveiling of the Canyon Heights Park plan.

          C. Petersen - The Planning Commission has held several Work Sessions to review the sign ordinance. At least one more meeting is needed and will be scheduled for November 3 at 7:00 p.m.

          Rodney Despain - See handouts. Documents distributed regarding amendments to the City Code, Title 10, Zoning Regulations, that are required by State law dealing with the amendment process and the procedure for Public Hearings. He would like the Planning Commission to look at the proposed language at the Work Session. It will be the first item on the Work Session agenda. Current, City law requires a Public Hearing before the City Council. State law now requires a hearing before the Planning Commission. This amendment would bring the City Code in compliance with State law. Kim Holindrake will notice a hearing for the November 17 Regular Planning Commission meeting.

          The Planning Commission would like to ask David Bunker about the lights at the LDS Stake Center located at 4600 West/Cedar Hills Drive.
