PLANNING COMMISSION MEETING

 

1.         This meeting of the Planning Commission of the City of Cedar Hills, having been posted throughout the City and the press notified, was called to order by C. Petersen at 7:08 p.m.


            Paul Hammer was recognized as a voting member.

 

2.         Approval of the Minutes from the April 28, 2005, Regular Planning Commission Meeting (7:08 p.m.)


MOTION: C. Petersen - To approve the minutes from the April 28, 2005, Regular Planning Commission Meeting, as amended. Seconded by C. Richardson.

MOTION: C. Hammer - To move Item #3 behind Item #4. Seconded by C. Richardson.


            C. Hammer said he wanted to report on his assignment first because he would have to leave early.

4.         Committee Assignments and Reports (7:10 p.m.)

 

Parks and Trails Committee - C. Hammer was not able to attend the Parks and Trails Committee meeting.

 

3.         Review/Recommendation on Sign Ordinance (7:11 p.m.)

 

See handouts. C. Petersen suggested that the Commission look at the sign ordinance differently. He found a summary of a sign ordinance from Collier County, Florida and liked the language and approach that this county used. It requires permits not just to construct a sign, but to display a sign. It also requires that every sign have a sign permit number displayed on it to make enforcement easy.


The language in the document is simple and straightforward. C. Hammer suggested that rather than try to pick apart the sign ordinance, the Commission should start with constructing an outline and then fill in the outline.

The Commission determined they would like the following sections in the Sign Ordinance:

          Purpose and Intent

          Authority to Interpret and Enforce 

          Sign Permit Process 

          Definitions 

          Sign Types, with the following subheadings: 

1) Ground, 2) Pole, 3) Wall, 4) Mansard, 5) Canopy or Awning, 6) Flags, 7) Political, 8) Banners, 9) Temporary Signs, with the following sub-sub heading: a) Real Estate, b) Construction


The Commission made a list of words that should be defined, including:

          Signs

          Snipe Sign

          Pole

          Monument

          Temporary

          Political Sign


The Commission made a list of signs that are exempt from permits, including:

          Government regulation

          Professional nameplates

          On-premise directional signs

          Memorial plaques, cornerstones, commemorative signs

          Address identification

          Open House

          No trespassing

          Religious

          Traffic/safety


The Commission would like to consider listing prohibited signs. That section would include:

          All signs not expressly permitted, are prohibited.


In any case, the following are expressly prohibited:

          Abandoned signs

          Rotating, flashing, animated or activated signs

          Signs in the right of way

          Billboards

          Roof signs

          Neon signs

          Portable signs

          Snipe signs

          Wind signs

          Beacons

          Signs that are a safety hazard or nuisance

          Pole signs

C. Hammer said he had conflict about the sign ordinance. He said that he feels that he should not impose his will on what someone does with their property, whether it is with alcohol sales, Sundaybusiness or signs they can post.
