1.         This meeting of the Planning Commission of the City of Cedar Hills, having been posted throughout the City and the press notified, was called to order at 7:05 p.m. by C. Petersen.

 

2.         Approval of the Minutes from the November 17, 2005, Regular Planning Commission Meeting (7:05 p.m.)

3.         Hearing/Review/Recommendation on Preliminary for Hullinger Property Located at 9730 N Canyon Road (7:07 p.m.)

4.         Hearing/Review/Recommendation on Preliminary/Final on Canyon Heights at Cedar Hills, Plat I (7:10 p.m.)

 

See handouts. There is a subdivision that backs up to this subdivision. Four homes were built that did not conform to the side-yard setback based on the true property lines. A new plat had to be drawn to redefine the property lines. This is a re-subdivision of Lots 38, 39, 40, and 41 of Canyon Heights, Plat B. There are a few corrections that need to be made on the plat. They are technical items that should not hold up approval of the plat, such as removing easements. City staff recommends approving the final plat. All owners, except those at 9079 N Silver Lake Drive, were present but this owner is in favor. All owners will need to sign the new plat. The existing buildings do not need to be shown on the final plat.


MOTION: C. Richardson - To recommend preliminary and final plat approval for Canyon Heights, Plat I, subject to the abandonment of the old easements and the recording of new easements on the plat. Seconded by C. Maxwell.

5.         Review/Action on Concept for Landon Court Estates (7:25 p.m.)

 

See handouts. This is a proposal to subdivide a parcel with an existing home on it into six residential lots. Lot 2 has an existing home on it. Issues to be addressed:

          There is an 8-inch sewer main between Lots 1 and 2 culminating at a manhole that would split two laterals.

          There is a lot that will not have access to the sewer because it drops off too quickly. There needs to be an alternate way to hook to the sewer.

          If the sewer line is moved to the southern side on Lot 1 with a lateral at the back of Lot 6, the lots can be serviced as well as future development.

          Lot 6 is irregular shaped. The frontage has a 30-foot setback and is off the bulb. The rear lot line needs to be defined. Shortening and shifting the cul-de-sac 13 feet to the north would help the problem with the Lot 6 setbacks. Rodney Despain said that he does not feel that it is a problem to have the west setback as the rear setback. A compromise is to require a 20-foot setback there.

          The private drive has to be a hard surface with curb and gutter. It can access up to five lots; the drive would belong to Lot 6.

          Lots 1, 2 and 3 can receive water service from the City of Cedar Hills. Manila Water would service Lots 4, 5 and 6. It might be possible to service all lots with Cedar Hills water by running a line 10 feet off the sewer. The Commission would like a letter from Fred Levine stating that he approves of the development.


MOTION: C. Richardson - To recommend concept approval for Landon Court Subdivision, subject to the following: 1) Moving the private lane bulb 13 feet to the north, 2) Indicating a rear lot line for Lot 6 on both the southernmost and westernmost sides, 3) Showing a 20-foot public utility easement on the southernmost side of Lots 1 and 6, 4) Allowing for the decrease of the public utility easement on the north side of Lot 1 to 10 feet, 5) Installing the sewer line and potential water line along the southernmost side of Lots 1 and 6, 6) Updated sewer plans to include access for all lots, and 7) An agreement for the Levin property. Seconded by C. Maxwell.

C. Petersen opened the Public Hearing on Preliminary/Final on Canyon Heights at Cedar Hills, Plat I. There were no public comments. C. Petersen closed the public hearing.

3.         Hearing/Review/Recommendation on Preliminary for Hullinger Property Located at 9730 N Canyon Road (8:12 p.m.)

 

C. Petersen opened the Public Hearing on Preliminary for the Hullinger property. There was no public comment. C. Petersen closed the Public Hearing.

 

See handouts. The Hullinger property is located at 9730 N. Canyon Road. It is a two-lot subdivision consisting of an existing home on Lot 1. Lot 2 has an existing building that will be removed.

          Lot 1 is on a septic system and does not have sanitary sewer access. Sewer access would be required for both lots.

          Water service would be required for Lot 2. Manila Water currently services Lot 1. Lot 2 would need to come onto Cedar Hills water.

          Pressurized Irrigation would be required for Lot 2 as well.

          If a combination curb, gutter and sidewalk are installed, the sidewalk needs to be five feet wide. Brandon Wyatt, the engineer on this project, said that the sidewalk on Box Elder Drive is only four feet wide. They would like to do the same, if possible. City standards have changed to 5-foot for a combination curb, gutter, and sidewalk.

          The developer has spoken with UDOT to change the driveway access. C. Steele asked if it was possible to prohibit backing up from the driveways onto Canyon Rd. David Bunker said that because Canyon Road is a State road, the City does not have the authority to make those prohibitions.

          Water rights are required for Lot 2. One acre foot is required.


MOTION: C. Maxwell - To recommend Preliminary Approval on the Hullinger Subdivision, subject to: 1) Sidewalk shall be 5 feet wide for combination, 2) Approval from UDOT for the additional driveway access for Lot #2 shall be required, 3) All final engineering including the final plat shall be submitted for approval, 4) Water rights for Lot #2 shall be submitted, 5) Fire hydrant locations shall be shown; all structures must be within 250 feet of a Cedar Hills hydrant, 6) Sanitary sewer service shall be required for each lot, 7) Sewer main profile shall be submitted, 8) Culinary water service shall be required for both lots, and 9) Submission of final plat. Seconded by C. Richardson.

6.         Approve Meeting Schedule for the Year 2006 (8:24 p.m.)


MOTION: C. Steele - To adopt the Planning Commission’s 2006 meeting scheduled as proposed, with the exception that there be no meeting in December, there be a meeting November 30 and all other meetings on the 4th Thursday of the month. Seconded by C. Maxwell.

7.         Review/Recommendation on Sign Ordinance (8:29 p.m.)

 

See handouts. The following changes should be made:

          Page 2, Number 2 should read: “Signs not specifically allowed herein are prohibited. The following signs are expressly prohibited.”

          Page 10, Development Signs: Change the sign area to no greater than twenty-four (24).

          Page 10, Commercial Zone, Permanent Signs, “shall have a sign area no greater than fifteen percent (15%) of the facade”

          Page 11, Enforcement: change the first “shall” to “may,” “confiscation” to “removal,” and “confiscate” to “remove.”


MOTION: C. Richardson - To set a Public Hearing for the next meeting and put the recommendation of adoption of the Sign Ordinance on the agenda. Seconded by C. Maxwell.

8.         Committee Assignments and Reports (9:07 p.m.)

 

No reports.

          C. Steele recognized and thanked C. Richardson for his service on the Planning Commission.

          In response to C. Steele’s earlier question about prohibiting backing up onto Canyon Road, Rodney Despain said that the Commission could restrict backing on the highway by requiring the design of driveways and homes to allow access to the road by forward motion only. The Commission would like to consider this. Rodney Despain will give the Commission suggestions.
